    • This User Agreement together with all policies and documents referred to in it are referred to as our “Terms of Use”.Our Terms of Use tell you the terms (including rights, obligations and restrictions on you) on which you may use our site and/or services, including:

      • via all channels for accessing and using our site including personal computer, mobile, web, wireless, console, desktop and any other technology or device;
      • via applications on any operating system (including Google Android and Apple iOS apps); and/or
      • via third party sites or links (including social media),
    • Please read our Terms of Use (including this User Agreement) carefully before you use our site.We recommend that you print and/or save a copy of our Terms of Use for future reference.
    • By using our site (in any way), you confirm that you accept and will comply with our Terms of Use.This includes that you agree to the collection and use of your personal data in accordance with our Privacy Policy.
    • If you do not agree to and accept our Terms of Use (including this User Agreement), you must not use our site.
    • Your use of our site via third party media (including mobile / tablet apps and/or third party sites or links), and/or your use of any third party media or services in connection with our site (including YouTube, Facebook, Twitter, Snapchat, Instagram and/or Stripe), may be subject to separate terms and conditions as required and provided by the relevant third party(ies).You are responsible for reviewing these and you make use of third party media and/or services at your own risk.
    • Our Terms of Use are written in English.Should any translation conflict with the English version, the English version will prevail.

  • Who we are & what we do
    • Our site is operated by Phil Wilson Tour and Music Management Limited (referred to as "we" or “us”).We are a limited company registered in England and Wales under company number 10210667 with our registered office at c/o OJK Ltd 19 Portland Place, London W1B 1PX.Our VAT number is 244 2994 87.
    • Our site is made available for the purpose of facilitating, operating, and promoting the business of BANDZIT®, which includes the provision of a platform by which users may buy and sell tickets for live events (our “stated purpose”).You agree to use and/or interact with our site in accordance with our stated purpose.
    • Our site includes a platform by which users may buy and sell tickets for live events; however we are not responsible for the transaction between the buyer and seller – we are merely a facilitator.
  • We may make changes to these terms
    • We may amend these terms from time to time. Every time you wish to use our site, please check these terms to ensure you understand the terms that apply at that time.
    • These Terms of Use were most recently updated on [03 April 2017] [(Version 1.0)].
  • We may make changes to our site
    • We may update and change our site and its content from time to time for maintenance and/or to reflect changes to our products and/or services, our users' needs and our business priorities. We may from time to time release new services, features, tools and resources on our site and/or release new versions of our site (or any part of it). Any new services, features, tools, resources or versions will be subject to these Terms of Use and/or any additional terms that we may issue for those specific services, features, resources or versions.
    • We will try to give you reasonable notice of any major changes to our site.
  • We may require you to register to use our site
    • Our site is made available to browse as a guest user. However, we may require you to register to use of our site, including certain features, services and/or products, at our sole discretion.
    • We reserve the right to change registration requirements (including which aspects of our site and its features, services and/or products require user registration) at any time upon reasonable notice to you.
  • We may charge you to use our site
    • Our site is made available free of charge. However, we reserve the right to charge fees and/or payments (whether one-off or recurring) for the use of our site, including certain features, services and/or products, at our sole discretion.
    • We will give you reasonable notice of applicable fees and/or charges.If you wish to receive or use the relevant features, services and/or products you must pay the applicable fees and/or charges.
    • We reserve the right to change fees and/or charges at any time upon reasonable notice to you.
  • We may suspend or withdraw our site
    • We do not guarantee that our site, or any content on it, will always be available or be uninterrupted (including by reason of distributed denial-of-service attacks, unsupported mobile and/or web browsers and/or unsupported operating systems).
    • We may suspend or withdraw or restrict the availability of all or any part of our site for business or operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
    • You are responsible for making all arrangements necessary for you to have access to our site and for any associated costs (including charges by your service provider and/or credit card or other transaction fees).
    • You are also responsible for ensuring that anyone who accesses our site through your internet connection (whether or not such internet connection is password-protected) is aware of these Terms of Use and any other applicable terms and conditions, and that they comply with them.
  • Our site is for users in the UK
    • Our site is directed to people residing in the United Kingdom. We do not represent that content available on or through our site is appropriate for or available in other locations.
  • Becoming a registered user
    • Our site permits a number of different types of registered user (each a “user type”) as we may determine from time to time, including:
  • You are responsible for your user account
    • If you choose, or you are provided with, a username, identification code, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to anyone else.
  • How you may use material on our site
    • We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it (including artwork, graphics, images, literary works, source and object code, computer code (including html), applications, audio, music, video and other media, designs, animations, interfaces, methods, products, algorithms, data, interactive features and objects, advertising and acquisition tools and methods, inventions, trade secrets, logos, domains, customised URLs, trade marks, service marks, trade names and other proprietary identifiers).Those works are protected by intellectual property laws and treaties around the world. All such rights are reserved.
  • BANDZIT® is a registered trade mark
    • “BANDZIT” is a trade mark owned by us and registered in the European Union (EU Trade Mark Registration Number 015795438).
  • Do not rely on information on our site
    • The content on our site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our site.
  • We are not responsible for sites we link to
    • Where our site contains links to other sites and/or resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them.
  • User-generated content is not approved by us
    • Our site may include information and materials uploaded by other users of the site. This information and these materials have not been verified or approved by us. The views expressed by other users on our site do not represent our views or values.
  • Our responsibility for loss or damage
    • Nothing in these Terms of Use excludes or limits in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  • Posting, uploading and providing content to our site
    • Whenever you post, upload or otherwise provide content to our site, including videos, images, likeness, logos, photos, artwork, designs, animations, audio files, recordings, compositions, illustrations, interfaces,text, literary works, name(s) (including professional or stage name(s)), contact details or other information relevant to your interaction with our site and/or your use of or registration with our site, and/or to make contact with other users of our site (collectively referred to as “User Content”), you must comply with the content standards set out in our Acceptable Use Policy.
  • Rights you give us to use material you post, upload and provide
    • When you post, upload or otherwise provide content (including User Content) to our site, you grant us the following rights to use that content:
  • We are not responsible for viruses and malware and you must not introduce them
    • We do not guarantee that our site will be secure or free from bugs, viruses or other malicious software or code and we will not be liable to you for any distributed denial-of-service attack, trojan, worm, logic bomb, malicious software or code, bug, glitch, error, delay, inaccuracy, or other content or material which is malicious or harmful or destructive, that may affect your technology, devices, applications, programs, data, User Content, or other material due to your use of our site, or on any site or service linked to our site.
  • Rules about linking to our site
    • You may link to any part of our site, provided you do so in a way that is fair and legal and does not damage or take advantage of our reputation or the reputation of any other user.
  • Claims and applicable law
    • The provisions of these Terms of Use, and their subject matter and formation, are governed by English law.
  • How to contact us

collectively referred to as “our site”.

Our Terms of Use apply to anyone who uses our site (referred to as a “user”).

Use” of our site includes accessing, browsing, posting, uploading, or registering to use our site (including as guest).

We are not a party to the agreement or arrangements between buyer and seller relating to the purchase or sale of tickets using our site, and we cannot guarantee that users complete or fulfil any transaction.

When tickets are bought and sold using our site, the contract is directly between the buyer and the seller.This User Agreement is your contract with us in respect of your use of our site.For more information on the rules applicable to the buying and selling of tickets via our site, please see our Ticketing Policy for Buyers and our Ticketing Policy for Sellers.

  • Fans; and
  • Musicians / Artists;
  • Venues; and
  • Booking Agencies.
    • You may register as one or more of the user types. Your choice of user type will determine access to certain BANDZIT® features, services and/or products.
    • To register as a registered user you must provide us with your real name, your valid email address and other information requested.You must ensure that the information you provide is, and remains, valid, accurate and up-to-date. Your email address and any other information you provide about yourself will be treated in accordance with our Privacy Policy.
    • You must not provide false personal information to us or via our site or create an account for anyone other than yourself.
    • You are responsible for all use of your account, username, and password and any and all activity under your account, including any of User Content (as defined in paragraph 18 of this User Agreement) posted or provided to our site under your username.
    • Where paid services are purchased via a user account, we will consider the owner of that user account to be the person whose billing information was used to purchase those paid services.
    • We have the right to disable, suspend, cancel, remove or reassign user accounts, usernames and/or passwords in appropriate circumstances determined by us, including if activities occur on a user account which, in our reasonable opinion, would or might constitute a violation of any provision of or the spirit of these Terms of Use or an infringement or violation of the rights of anyone else or of any applicable laws or regulations.
    • If we disable your account, you must not create another account without our permission.
    • If you know or suspect that anyone other than you knows your username or password or otherwise has access to your account, you must promptly notify us at support@bandzit.com and you should change your password at the earliest opportunity.
    • Please note that if you delete your account, content and/or data you have posted and/or provided may remain on our servers for a limited period of time as part of our backup system.
    • You may print off one copy, and may download extracts, of any page(s) from our site for your personal use (only) and you may draw the attention of others to content posted on our site.
    • You must not modify any materials you have printed off or downloaded in any way, and you must not use any illustrations, photographs, video, audio or graphics separately from any accompanying text.
    • Our status (and that of any identified contributors) as the authors of content on our site must always be acknowledged.
    • Other than as specifically provided for in these Terms of Use, you must not use or authorise anyone else to use any part of the content on our site for commercial purposes without obtaining a licence to do so from us or our licensors.
    • If you print off, copy or download any part of our site in breach of these Terms of Use, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.
    • The Bandzit logo(s), as adapted or updated from to time, are trade mark(s) owned by us, including:
    • You are not permitted to use BANDZIT® or any of our trade marks in any way except as permitted in paragraph 12 of this User Agreement.
    • Although we make reasonable efforts to update the information on our site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.
    • We have no control over the contents of those sites or resources.
    • If you wish to complain about information and/or materials uploaded by other users please contact us on support@bandzit.com.
    • To the extent permitted by law, we exclude all implied conditions, warranties, representations or other terms that may apply to our site or any content on it.
    • We will not be liable to you or any user for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with:
  • use of, or inability to use, our site;
  • use of or reliance on any content displayed on our site; or
  • breach by users of our Terms of Use.
    • In particular, we will not be liable for:
  • loss of profits, sales, business, or revenue;
  • business interruption;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss or damage.
    • We are not responsible for the acts or omissions of users of our site (including Fans, Musicians / Artists, Venues and/or Booking Agencies), including where there has been an error or a misrepresentation, save as expressly set out in our Ticketing Policy for Buyers and our Ticketing Policy for Sellers.
    • We are not responsible for any of the live events for which tickets are listed or purchased via our site and we do not make any guarantees or representations that such live events will take place and/or in the manner advertised.
    • If defective digital content that we have supplied, damages a device or digital content belonging to you, we will not be liable for damage that you could have avoided by following our advice to apply an update offered to you free of charge or for damage that was caused by you failing to correctly follow installation instructions or to have in place the minimum system requirements advised by us.
    • You agree to indemnify (compensate) us and keep us indemnified in full for any claims, losses, expenses, damages, costs (including reasonable legal fees) and liabilities we incur as a result of your use of our site, or as a result of any breach or alleged / suspected breach by you of these Terms of Use, or any use by you of our site which is unlawful or improper or which goes against the spirit of these Terms of Use, or your breach or violation of any law or the rights of any third party.
    • You warrant (i.e. legally promise) that:
      • You own or control any User Content uploaded, posted or provided by you;
      • Your contributions, listings and activities comply with our Acceptable Use Policy and (if applicable) our Ticketing Policy for Buyers and our Ticketing Policy for Sellers and all of our Terms of Use; and
      • You have the right to allow us and our designees to use such User Content in accordance with these Terms of Use.
    • You will be liable to us and indemnify us for any breach of these warranties.This means you will be responsible for any loss or damage we suffer as a result of your breach of warranty.
    • You agree that we have no obligation to accept, post, publish or host any information or content provided or uploaded by you (including ticket listings) and we have complete discretion as to how, when and for how long such content is featured, hosted or present on our site.
    • Any content you upload to our site will be considered non-confidential and non-proprietary. You retain all of your ownership rights in your User Content, but you are required to grant us and other users of our site a licence to use, store, copy, distribute and/or exploit that content in accordance with our Terms of Use. The rights you license to us are described in paragraph 19 below.
    • We have the right to disclose your identity and/or actions and/or your User Content to law enforcement authorities as we feel is necessary and/or to any third party who claims that User Content uploaded, posted or provided by you constitutes a violation of their intellectual property rights, or any other rights including their right to privacy.
    • We are permitted, but not obliged, to monitor User Content and/or other content or information uploaded, posted or provided via our site, but we are not responsible for monitoring User Content.
    • If in our opinion your User Content does not comply with our Terms of Use, including the content standards set out in our Acceptable Use Policy, we reserve the right in our absolute discretion to take action as we deem appropriate which may include removing any User Content, disabling or removing or reassigning user accounts, usernames and passwords, and/or putting in place technical and/or legal steps to prevent you from using and/or interacting with our site and/or users on our site in any way.
    • You must not upload, store, distribute, send, transmit, display, perform, make available or otherwise communicate to the public and/or any user of our site any content (including User Content) to which you do not hold the necessary rights.
    • Unauthorised use of any copyright protected material (including reproduction, distribution, modification, adaptation, public display, public performance, making available or otherwise communicating to the public via our site) may constitute an infringement of third party rights and is strictly prohibited.Where any such infringement occurs or is reasonably suspected, we have the right, in our absolute discretion, to take action as we deem appropriate, which may include removing the material and/or disabling or reassigning user accounts, usernames and passwords, and/or putting in place technical and/or legal steps to prevent you from using and/or interacting with our site and/or users on our site in any way.You may also be subject to civil and/or criminal proceedings brought by us and/or by or on behalf of the relevant rightsholder.
    • You are solely responsible for securing and backing up your content.
      • a non-exclusive, perpetual, royalty-free, worldwide, sub-licensable and transferable right to use, reproduce, publish, store, make available, distribute, broadcast, adapt and/or modify such content in any media as part of and/or in connection with (including promotion of) our site (via all channels) and/or our business; and
      • the right to make such content (or any part thereof) available to other users of the site and/or third parties,
    • A separate licence will be granted with respect to each item of content.
    • You waive any claims against us or anyone on our behalf relating to any past, present or future moral rights, artists’ rights or any other similar rights worldwide that you may have in or to such content with respect to the uses provided for in paragraph 19.1.
    • You are responsible for configuring your technology, devices, computer programmes and platform to access our site. You should use your own virus and malware protection software.
    • You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is or is intended to be malicious, harmful, destructive or invasive.
    • You must not use any “robot”, “spider” or other automatic device, program, script, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, or monitor any portion of our site or services (or its data) or in any way reproduce or circumvent the navigational structure or presentation of any of our site to obtain or attempt to obtain any materials, documents, services or information through any means not purposely made available via our site.
    • You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site and/or other user accounts and/or content.
    • You must not attack our site via a denial-of-service attack or a distributed denial-of service attack.
    • You must not purchase search engine or other pay per click keywords (such as Google AdWords), or domain names that use our trade marks (as set out at paragraph 13 above) and/or variations or misspellings of our trade marks.
    • You must not reverse look-up, trace, or seek to trace another user of our site, or otherwise interfere with or violate any other users’ right to privacy or other rights or harvest or collect personally identifiable information about visitors or users of our site without their express and informed consent.
    • You must not disable, circumvent, bypass or otherwise avoid any measures used to prevent or restrict access to our site, the account of another user(s) or any other systems or networks connected to our site by hacking, password mining or other illegitimate or prohibited means.
    • You must not probe, scan, or test the vulnerability of our site or any network connected to the our site.
    • You must not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the our site or the systems or networks connected to our site, or otherwise interfere with or disrupt the operation of our site, or the servers or networks that host our site or make our site available, or disobey any requirements, procedures, policies, or regulations of such servers or networks.
    • You must not use our site in connection with any form of spam, unsolicited mail, fraud, scam, phishing, “chain letters”, “pyramid schemes” or similar conduct or otherwise engage in unethical marketing or advertising on or via our site.
    • By breaching this paragraph 20, you may commit a criminal offence under the Computer Misuse Act 1990. We may report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.
    • You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
    • We reserve the right to withdraw linking permission without notice.
    • The site or service in which you are linking must comply in all respects with the content standards set out in our Acceptable Use Policy.
    • If you are a consumer, you and we both agree that the courts of England and Wales will have exclusive jurisdiction except that if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, and if you are resident of Scotland, you may also bring proceedings in Scotland.
    • If you are a business user, you and we both agree to the exclusive jurisdiction of the courts of England.
    • If any of the provisions of these Terms of Use are held to be invalid, void or unenforceable, the remaining provisions will remain in full force and effect.
    • Nothing in these Terms of Use will be deemed or interpreted to limit or affect any other legal and/or statutory rights that you may have.
    • If you are a consumer, your local Citizens Advice Bureau may be able to advise you on your consumer rights.

This means that you have obtained all rights, licences, consents, authority and permissions necessary in order to use, and (if applicable) to authorise us and our designees to use, publish, transfer or license any of the rights and interests in and to such User Content in accordance with these Terms of Use.

which shall continue even after you delete your account and/or your content from our site and/or otherwise cease to use our site.
